📓 Terms of Use
Chapter 1: General Provisions
[Article 1 (Terms of Use)]
These Terms of Use (hereinafter referred to as the "Terms") constitute the conditions for granting rights to you when you use "Bokura no Saga" (hereinafter referred to as the "Service"), operated by Hoget Co., Ltd. (hereinafter referred to as the "Operating Company").
Accordingly, you must use the Service in accordance with these Terms. If you do not agree to these Terms, you may not use the Service.
Furthermore, if you are under the age of 20, you must obtain the consent of your legal guardian (parent, etc.) before agreeing to and accepting these Terms.
[Article 2 (Application and Scope of Terms)]
- These Terms apply to all use of the Service by users (as defined in Article 5) (hereinafter simply referred to as "Users").
- Notices issued by the Operating Company to Users as set forth in Article 4 constitute part of these Terms.
[Article 3 (Changes to Terms)]
- The Operating Company may change these Terms without the User's consent. In such cases, the terms of use of the Service will be governed by the changed Terms.
- The changed Terms will take effect from the time they are displayed on the Official Website (displaying on any screen is hereinafter referred to as "posting"), unless otherwise specified by the Operating Company.
[Article 4 (Notices from the Operating Company)]
- The Operating Company will notify Users of necessary matters from time to time by posting or by any other method the Operating Company deems appropriate.
- The notice referred to in the preceding paragraph will take effect from the time the Operating Company posts the contents of the notice on the Official Website, or from the time it is received if notified by any other method.
Chapter 2: User Obligations and Responsibilities
[Article 5 (Users)]
"User" means a person who uses the Service based on the qualifications that allow legitimate use of the Service (hereinafter referred to as "User Qualifications").
[Article 6 (Rights of Use)]
- The Service includes machine-readable instructions, their components, data, audiovisual content (images, text, photographs, animations, videos, music, etc.), and various materials such as manuals.
- The copyright and all other intellectual property rights related to the Service and Software are owned by the Operating Company or its designee. The Operating Company grants users a license to use the Service solely for the purpose of using the Service within the scope set forth in these Terms and Conditions; the Operating Company does not sell the Service. The Operating Company grants users a non-exclusive, non-sublicensable, non-transferable right to use the Service, subject to their agreement to these Terms and Conditions.
- The trademarks, logos, and service marks (collectively "Trademarks") displayed on the Service are registered or unregistered trademarks of the Operating Company or third parties. The Operating Company does not assign or license any of these Trademarks to users or other third parties under these Terms and Conditions.
[Article 7 (Prohibition of Transfer, etc.)]
Users may not transfer their user status or any other rights they hold as a user to a third party, or sell, rent, lease, lend, transfer ownership, pledge, or otherwise offer them as security.
[Article 8 (Facilities, etc.)]
- Users shall prepare, at their own expense and responsibility, all hardware, operating systems, other software, lines, and other necessary equipment to use the Service.
- Users acknowledge and agree that, in addition to the above, communication fees such as telephone charges, internet connection fees, electricity charges, and other fees necessary to use the Service will be incurred separately and shall bear all such fees.
[Article 9 (Account Creation)]
- Creating an account is required to log in to the Service.
- Users agree that their account information (including all information registered as account information) will be used as account information when using the Service.
[Article 10 (Principle of Self-Responsibility)]
- Users shall be solely responsible for their use of the Service, and for all actions taken using the Service, as well as the consequences thereof.
- If a User causes damage to the Operating Company or another party through an act in violation of these Terms (including cases in which a User's failure to fulfill their obligations under these Terms causes damage to another party or the Operating Company), the User shall compensate for such damage at their own responsibility and expense.
- Users shall take appropriate breaks at their own discretion so as not to disrupt their living environment due to excessive use of the Service. The Operating Company shall not be liable for any social, physical, or mental damage caused by a User's inappropriate use of the Service.
[Article 11 (Obligation to Confirm Notifications)]
Users shall be obligated to regularly confirm the content of online notifications provided by the Operating Company pursuant to Articles 3 and 4.
[Article 12 (Prohibited Acts)]
Users must not engage in the following acts when using the Service.
- Acts that violate the law, court judgments, decisions, or orders, or legally binding administrative measures.
- Acts that infringe the copyrights, trademarks, or other intellectual property rights of the Operating Company or others.
- Acts that infringe on the property, privacy, or publicity rights of others.
- Acts that discriminate against, slander, or damage the reputation or credibility of others.
- Acts that are linked to fraud or other crimes.
- Acts that transmit or display documents, etc. that constitute obscenity, child pornography, or child abuse, or acts that sell media containing such documents, images, etc., or acts that display or transmit advertisements that suggest the transmission, display, or sale of such documents, images, etc.
- Acts that violate laws regarding the prevention of stalking, etc.
- Acts that establish or solicit for pyramid schemes.
- Using the Service by impersonating another person, such as an employee of the Operating Company, support staff, or another user.
- Pre-election campaigning, election campaigning, or similar activities, or activities that violate the Public Offices Election Act.
- Religious activities or acts of soliciting to organizations.
- Sending advertising, publicity, solicitation, or other messages to others without permission, or sending hateful messages.
- Accessing the Operating Company's or another person's equipment for the Service (meaning communications equipment, communications lines, computers, other devices, and software used on such devices provided by the Operating Company to provide the Service; the same applies hereinafter) without authorization, or acts that interfere with its use or operation.
- Collecting personal information of others without their consent or by fraudulent means.
- Failure to follow legal procedures such as notification to supervisory authorities or obtaining licenses and permits, or other acts that violate such laws and regulations.
- Disclosing the personal information of others.
- Analyzing, decompiling, disassembling, or reverse engineering software provided by the Operating Company or its communications content.
- Redistributing, lending, or selling to others (unless approved by the Operating Company).
- Reproducing the Software beyond the scope necessary for User use.
- Modifying, interfering with, or hacking into the Service.
- Using bugs or malfunctions for unauthorized purposes or communicating them to others.
- Using a server emulator that provides a service that can replace all or part of the Service, or developing or using other utilities related to the Service.
- Using, creating, or distributing external tools that exploit unintended bugs in the Service or that have unintended effects.
- Using the Service for purposes other than those intended by the Service.
- Making false reports to the Operating Company.
- In addition to the above, any acts that violate laws and regulations, these Terms, or public order and morals (such as violence and cruelty), interfere with the operation of the Service, damage the Operating Company's reputation or infringe on the Operating Company's property, or cause harm to others or the Operating Company.
- Providing information on where to post text or data that solicits or instructs others on how to engage in any of the above acts (including cases where such acts are being engaged in by others) with the intent of encouraging such acts.
[Article 13 (Service Usage Fees)]
- The Operating Company may change the usage fees for the Service.
- Service usage fees, accrual standards, calculation methods, etc. shall be as separately posted.
Chapter 3: Operation of the Service
[Article 14 (Restrictions on Use of the Service, etc.)]
- The Operating Company may suspend the provision of the Service to a User without the User's consent if it deems it necessary for the smooth operation of the Service.
- The Operating Company shall not be liable for any damages incurred by Users due to the Operating Company's inability to use the Service as a result of the measures set forth in the preceding paragraph.
[Article 15 (Changes to the Content of the Service)]
The Operating Company may change the content of the Service without prior notice to Users.
[Article 16 (Temporary Suspension of the Service)]
- The Operating Company may temporarily suspend provision of the Service without prior notice to Users if any of the following events occur: (1) When performing regular or emergency maintenance on the equipment used for the Service. (2) When the Service cannot be provided due to a fire, power outage, etc. (3) When the Service cannot be provided due to a natural disaster such as an earthquake, volcanic eruption, flood, or tsunami. (4) When the Service cannot be provided due to war, unrest, riots, civil unrest, labor disputes, etc. (5) When the Operating Company determines that a temporary suspension of the Service is necessary for other operational or technical reasons.
- The Operating Company shall not be liable for any damages suffered by users or others resulting from delays or interruptions in the provision of the Service due to any of the items in the preceding paragraph or for any other reasons.
[Article 17 (No Warranty)]
- The Operating Company warrants against physical defects in the Service and shall not be liable for any direct or indirect damages arising from the use or inability to use the Service.
- The Operating Company does not guarantee that the execution of the Service will be uninterrupted, that its execution will be error-free, or that all errors will be corrected.
- The warranty in this Article does not apply to force majeure such as natural disasters or causes attributable to the user (improper handling, loss, modification, improper repair, etc., whether intentional or negligent).
- The warranties in this Article 18 (Disclaimers) set forth all warranties regarding the Service and replace all express or implied warranties, including legal warranties against defects, warranties of merchantability, and warranties of fitness for a particular purpose.
[Article 18 (Disclaimers)]
- The Operating Company assumes no responsibility whatsoever for the completeness, accuracy, applicability, or usefulness of the Service or data provided by the Operating Company, or data registered by others.
- The Operating Company shall not be responsible for restoring data stored by a User on the Service Equipment or rights to items, etc. acquired by a User through purchases, if such data is lost (including due to expiration or deletion by the User) or tampered with by a third party.
- The content of the Service shall be that which the Operating Company can provide at the time, and the Operating Company's responsibility to Users shall be limited to the provision of the Service by the Operating Company in a manner that allows Users to use the Service without hindrance, as provided by a good administrator.
