Chapter 1 General Provisions

【Article 1 (Terms of Use)】

These Terms of Use (hereinafter referred to as "these Terms") set forth the conditions under which rights are granted when customers use "Bokura no Saga" (hereinafter referred to as "the Service") operated by Hoget Co., Ltd. (hereinafter referred to as "the Company").
Accordingly, customers shall use the Service in accordance with these Terms, and if they do not agree to these Terms, they may not use the Service.
In addition, if the customer is under 20 years of age, they must obtain the consent of a legal guardian (such as a parent or guardian) before agreeing to and accepting these Terms.

【Article 2 (Application and Scope of Terms)】

  1. These Terms apply to all matters related to the use of the Service by users (hereinafter simply referred to as "Users") as defined in Article 5.
  2. Notifications issued by the Company to Users as stipulated in Article 4 shall constitute a part of these Terms.

【Article 3 (Changes to Terms)】

  1. The Company may change these Terms without obtaining the consent of Users.
    In such cases, the conditions of use of the Service shall be based on the revised Terms.
  2. The revised Terms shall take effect from the time they are displayed on the official website (display on any screen hereinafter referred to as "posting"), unless otherwise specified by the Company.

【Article 4 (Notifications from the Company)】

  1. The Company shall notify Users of necessary matters from time to time by posting or by other methods deemed appropriate by the Company.
  2. Such notifications shall take effect at the time they are posted on the official website or, in the case of other methods, at the time they are delivered.

Chapter 2 Obligations and Responsibilities of Users

【Article 5 (Users)】

"Users" refers to individuals who use the Service based on qualifications that entitle them to legitimately use the Service (hereinafter referred to as "User Qualifications").

【Article 6 (Usage Rights)】

  1. The Service includes machine-readable instructions, its components, data, audiovisual content (images, text, photographs, animations, videos, music, etc.), and various materials such as manuals.
  2. All copyrights and other intellectual property rights related to the Service and the software belong to the Company or parties designated by the Company. The Company grants Users a license to use the Service only within the scope defined in these Terms and solely for the purpose of using the Service; the Service is not sold.
    The Company grants Users a non-exclusive, non-sublicensable, and non-transferable right to use the Service, provided that the User agrees to these Terms.
  3. Trademarks, logos, and service marks (collectively referred to as "Trademarks") displayed in the Service are registered or unregistered trademarks of the Company or third parties. The Company does not transfer or grant any license to use such Trademarks to Users or any third party under these Terms.

【Article 7 (Prohibition of Transfer, etc.)】

Users may not transfer, sell, rent, lease, lend, change the name of, pledge, or otherwise provide as collateral any User Qualifications or any other rights held as a User.

【Article 8 (Equipment, etc.)】

  1. Users shall prepare, at their own responsibility and expense, all hardware, operating systems, software, communication lines, and any other requirements necessary to use the Service.
  2. Users shall also bear any communication costs such as telephone charges, internet connection fees, electricity costs, and any other expenses necessary for using the Service.

【Article 9 (Account Acquisition)】

  1. An account is required to log in to the Service.
  2. Users agree that all information registered as account information will be used in connection with their use of the Service.

【Article 10 (Principle of Self-Responsibility)】

  1. Users shall bear all responsibility for their use of the Service, as well as for all actions taken and results obtained through the use of the Service.
  2. If a User causes damage to the Company or a third party through actions that violate these Terms (including cases where the User fails to fulfill obligations under these Terms), the User shall compensate for such damage at their own responsibility and expense.
  3. Users shall take appropriate breaks at their own discretion to avoid disrupting their living environment due to excessive use of the Service.
    The Company shall not be liable for any social, physical, or mental damage resulting from inappropriate use of the Service by Users.

【Article 11 (Obligation to Check Notifications)】

Users shall have the obligation to regularly check notifications issued online by the Company in accordance with Articles 3 and 4.

【Article 12 (Prohibited Acts)】

Users shall not engage in the following acts when using the Service:

  1. Acts that violate laws, court judgments, decisions, orders, or legally binding administrative measures.
  2. Acts that infringe intellectual property rights such as copyrights or trademarks of the Company or third parties.
  3. Acts that infringe the property, privacy, or portrait rights of others.
  4. Acts that discriminate against, defame, or damage the reputation or credibility of others.
  5. Acts that lead to criminal activities such as fraud.
  6. Acts of transmitting or displaying obscene materials, child pornography, or content related to child abuse, or selling media containing such content, or displaying or transmitting advertisements that suggest such acts.
  7. Acts that violate laws regulating stalking behavior.
  8. Acts of establishing or soliciting pyramid schemes.
  9. Acts of impersonating the Company’s employees, support staff, or other users.
  10. Acts related to election campaigning or similar acts that violate election laws.
  11. Religious activities or solicitation to religious groups.
  12. Sending unsolicited advertisements, promotions, or solicitations, or messages that cause discomfort to others.
  13. Unauthorized access to or interference with the Company’s or others’ Service equipment.
  14. Collecting personal information of others without consent or through fraudulent means.
  15. Failure to comply with legal procedures such as notifications or permits required by law.
  16. Disclosure of others’ personal information.
  17. Analysis, reverse compilation, disassembly, or reverse engineering of the software provided by the Company.
  18. Redistribution, lending, or selling to others (unless approved by the Company).
  19. Copying the software beyond the scope necessary for use.
  20. Modification, interference, or intrusion into the Service.
  21. Exploiting bugs or defects for improper purposes or sharing them with others.
  22. Use of server emulators or development/use of utilities related to the Service.
  23. Creating, using, or distributing tools that exploit unintended bugs or effects.
  24. Using the Service for purposes other than those intended.
  25. Providing false reports to the Company.
  26. Any other acts that violate laws, these Terms, or public order and morals, or that harm the Company or others.
  27. Encouraging or facilitating any of the above acts.

【Article 13 (Service Fees)】

  1. The Company may change the usage fees for the Service.
  2. Fees, conditions for occurrence, and calculation methods shall be as separately posted.

Chapter 3 Operation of the Service

【Article 14 (Restrictions on Use of the Service)】

  1. The Company may temporarily suspend the provision of the Service without prior consent if deemed necessary for smooth operation.
  2. The Company shall not be liable for any damages caused by such suspension.

【Article 15 (Changes to Service Content)】

The Company may change the content of the Service without prior notice.

【Article 16 (Temporary Suspension of the Service)】

  1. The Company may temporarily suspend the Service without prior notice in the following cases:
    (1) Maintenance of Service equipment.
    (2) Fire, power outages, etc.
    (3) Natural disasters such as earthquakes or floods.
    (4) War, riots, labor disputes, etc.
    (5) Other operational or technical reasons.
  2. The Company shall not be liable for damages caused by delays or interruptions.

【Article 17 (No Warranty)】

  1. The Company provides no warranty for defects or damages arising from use.
  2. The Company does not guarantee uninterrupted or error-free operation.
  3. This does not apply in cases of force majeure or user fault.
  4. This article replaces all other warranties.

【Article 18 (Disclaimer)】

  1. The Company assumes no responsibility for completeness or accuracy of data.
  2. The Company is not responsible for loss of data or items.
  3. The Company’s responsibility is limited to proper operation.
  4. The Company is not liable for damages caused by use or inability to use the Service.
    However, this does not apply in cases of gross negligence.
  5. Compensation is limited to the usage fee.

The Service is provided only within Japan.

【Article 19 (Termination of Service)】

  1. The Company may terminate all or part of the Service with prior notice.
  2. The Company is exempt from liability if proper procedures are followed.

【Article 20 (Measures Against Violations)】

  1. The Company may take actions such as warnings, deletion, or suspension.
  2. The Company is not obligated to take such measures.
  3. Actions may be taken without prior notice.

【Article 21 (User Disputes)】

The Company is not involved in disputes between Users unless necessary.

【Article 22 (Service Provider)】

The Service is developed and operated by the Company.

Chapter 4 Personal Information

【Article 23 (Personal Information)】

Handling of personal information follows the Company’s Privacy Policy.

【Article 24 (Deletion of Information)】

  1. The Company may delete or modify data if necessary.
  2. The Company bears no responsibility for such actions.

【Article 25 (Viewing Information)】

The Company may view user data if necessary.

Chapter 5 Test Services

【Article 26 (Test Services)】

  1. Test services may be provided temporarily.
  2. No liability is assumed for damages.

【Article 27 (Reporting Obligation)】

  1. Users should report bugs.
  2. Reports must follow designated methods.

【Article 28 (Operation of Test Services)】

The Company may modify or delete game data.

Chapter 6 Miscellaneous

【Article 29 (Operational Policy)】

Users must follow the site policy.

【Article 30 (Jurisdiction)】

Nagoya courts shall have exclusive jurisdiction.

【Article 31 (Governing Law)】

Japanese law applies. Even if part of these Terms is invalid, the rest remains effective.
